1. Our Obligations

1.1

These Terms and Conditions set out herein together with your confirmation invoice comprise your agreement with us and all those listed on the booking on whose behalf the

Party leader is acting

1.2

It is important that you check all the details shown on the confirmation invoice carefully to ensure they are correct as this forms the basis of the contract. Any discrepancies should be brought to our attention within 7 days of issue, or the details will be presumed correct.

2. Your Obligations

2.1

When you wish to confirm a booking you must pay a deposit of £150 / $300 per whole or part week. The deposit paid is non-refundable. You must make payment to us of the balance shown on the confirmation invoice at least 10 weeks prior to the first date of occupancy, or if your booking is made within this period you will have to pay the full amount immediately.

2.2

If you do not pay in full by the date shown on the confirmation invoice we reserve the right to cancel your booking if we so wish which will make you liable and you accept to pay for cancellation charges as set out in the table below.

3. General

3.1

. Pool heating is not included within the cost of your booking. If required please contact us prior to making your final payment and we can arrange for pool heating at the cost of £105 /$175 per week. Heating may be arranged locally at an additional charge of $25 per booking plus the pool heat tariff as above.

3.2

. The rental period begins at 4pm local time on the day of arrival and ends at 10am local time on the day of departure,(unless by prior arrangement with the owner and subject to an additional charge). Vacating after 10am may incur a charge equivalent to ones day’s rental unless previously agreed with the owner.

3.3

. The Charge for the villa rental includes accommodation for a maximum of 8 people: (as determined by fire safety regulations) , all utilities, water & electricity , all bed linen and towels, an end stay clean, all local, national and international telephone calls (free, when using correct procedure on telephone), all local taxes and the services of our local management co (although out-of hours calls may be subject to an additional charge made directly by the management co,)

3.4

We kindly ask that you take good care of our villa and leave it in a clean and tidy condition at the end of your stay. Please report any damage, problem, or loss immediately to our management co and also by email/text to the owner, as failure to do this will make any subsequent claim invalid. We also request that wet towels and clothing not be left on the floor or furniture in the villa as the pool is chlorinated and will stain and bleach any furnishings.

3.5

We also ask that all windows and doors remain closed at all times to maintain the correct working of the air conditioning; and for the security of your belongings., Please be aware that The air-conditioning ( or heating if rental is in the winter months) will automatically turn off if any windows or door are left open for longer that 5 minutes, A further 5 minutes after closing any open windows or doors will re-activate the air-conditioning Hilton Homes Florida 1019

4. Bookings

4.1

Bookings are only valid after you have completed, signed and returned the booking form to us, along with a signature of these Terms and Conditions by the lead member of your party. And we have confirmed the booking in writing or by email.

4.2

The signing of the booking form confirms the acceptance of the terms and conditions set out in these terms and conditions If you have booked through our website or printed off the booking terms and conditions, you will have been asked to read these Terms and Conditions and sign at the end of the form to say you agree to these Terms and Conditions and shall be binding on all of the persons intending to occupy the property whether or not such persons have signed the booking form .the lead name on the Booking Form will be responsible for the total price of the rental property as agreed.

4.3 It is important that you check all details on the booking form and confirmation letter carefully to ensure they are correct as this forms the basis of the contract between you and us. Any discrepancies should be notified immediately.

4.4

The signing or emailing of the booking form confirms the acceptance of these terms and conditions. These term and conditions shall be binding for all the persons listed and intending to occupy the villa, whether or not such persons have signed the booking form, The lead guest named on the booking form will be responsible for the total cost of the rental period as agreed.

4.5

The gated community is an unfinshed community and we cannot guarantee that there will not be building works during your stay 

5. Cancellation

5.

1 . If you cancel your accommodation, the lead name on the booking form must advise us in writing by registered post or email immediately. Verbal cancellations will only be accepted

If written confirmation follows within 7 days. If you cancel, you will be liable to pay the cancellation charges set out below

5.2

. Cancellation notification received by us . The following charges apply.

 56 days or more before departure

deposit only.

 28-55 days before departure

50% of full rental cost.

Within 28 days of departure 100% of full rental cost.


6. Cancellation by Owners or Management Company

6.1

. In the unlikely event that personal circumstances necessitate cancellation of the booking we will refund any monies paid by the party (without interest, liability for what ever nature,

Compensation or consequential or indirect loss of any kind).However the management company will always seek to relocate your booking to a villa of a similar or superior standard.

7. Force majeure

7.1

We, and our management co, accept no liability to pay compensation in respect of any loss, damage or changes arising from unforeseeable circumstances beyond our control (but not limited to) war or threat of war, terrorist activity, riots, political unrest, strikes, fires, floods, closure of airports, natural disasters and extreme weather conditions. You agree that your obligation to pay shall never be affected by an event of force majeure, however, we may refund monies up to the amount paid by the party

8. Sub-Letting

8.1

The accommodation booked is only available for use by those persons listed and included on the booking form unless otherwise agreed by us or our management co in writing, All persons occupying the villa including must be entered and listed on the booking form. Including young children and infants. This is Florida Law and must be adhered to. The accommodation cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the villa. The villa is fully licensed for short-term rentals in Florida, We reserve the right to refuse admittance if these conditions are not met. 9. Insurance

9.1

Insurance is not provided with this booking and you agree to arrange adequate cover for your trip and your party. All baggage and personal possessions remain at all times and in all circumstances at the owner’s risk. Our local management company or ourselves do not accept responsibility for any losses or damage howsoever caused. Guests are strongly recommended to take out adequate travel insurance to cover cancellation, accident/illness or damage.

10. Security or Breakage Deposit

10.1

. You are responsible for any damage caused to your holiday accommodation during your stay. You will be asked to provide a refundable security deposit of £200 / $400 at the time of the final balance payment, which is refunded in full as soon as the Management Company has inspected the home and reported no damage, In the meantime the security deposit will be held as security against loss or damage caused by any members(s) of your party. Our local management company checks the home before your arrival and after your departure and will advise us of any faults .This may include additional cleaning costs for removal of stains due to spillage (.refund of security deposit 14-28 days)

Breakages, ie. crockery/glasses/ small ornaments etc, please replace at your own expense where ever possible (they do not have to be exact replicas of the damaged article.)

10.2

. This rental home is designated as a NO SMOKING home, and all guests agree to refrain

From smoking inside the house . In the event that neutralization of smoke odours from cigarettes, cigars , pipes or other smoking materials is required, or in the event that burn marks from cigarettes , cigars, pipes, or other smoking materials are detected, the cost for elimination of those odours or repair of the burn marks will be deducted from the security deposit

10.3

.We reserve the right to retain the security deposit (either in part or full) to cover damage or non- return of keys. Receipts for repairs / replacements will be provided in the unlikely

event that such retention of the security deposit is required.

10.4

.You are responsible for any loss or damage greater than the amount of the security deposit, which must be paid within 14 days of being served notice of this.

11. Complaints

11.1

. The enjoyment of your vacation, and your satisfaction with the villa is paramount to us.

Please contact the local management company (or owners) if you experience any problems at all. Every effort will be made to assist but if the problem is not resolved then you need to notify us immediately. All complaints must be supported in writing within seven days and we cannot be responsible for complaints received after this period. A full investigation will be carried out and you will be notified as soon as possible.

12. Pets and Smoking

12.1

We do not permit pets in our villa;

12.2

Smoking is not permitted in the villa and restricted to outside the pool area, please use the ashtrays provided .

13. Safety and Security

13.1

To comply with state fire regulations, under no circumstances may more that the maximum number of persons identified on the booking form occupy the villa

13.2

Guests use the swimming pool and spa at their own risk. They should always observe the rules detailed in our information booklets and notices displayed in the patio/lanai and pool area. Guests are specifically asked not to allow unsupervised children to use the pool. A child safety fence is in situ for guests’ safety. The pool is 5ft deep at its deepest part, Please make sure your children are safe. No Glass is allowed in the pool area and plastics glasses/plates etc are provided for use outside. Guest should also take special care and avoid stepping on the indoor tiled floor. These tiles are very slippery when wet. We cannot accept any responsibility or liability whatsoever and howsoever caused for injury or damage as a result of the use of the pool. Hilton Homes Florida 1019

14. Code of Conduct

14.1

Bridgeford Crossing is a residential community. Members of your party should not interfere with the enjoyment of either other holidaymakers or residents of Bridgeford Crossings. Please do not play loud music or engage in any activity, which may cause inconvenience to you neighbours after 10.30pm or before 07.30am. In the event that any member of your party miss behaves or causes damage to any property of Bridgeford Crossings, then the owners or management company and their agents reserve the right of anytime .to have you removed from the property and Bridgeford Crossing.

15. Law

15.1

This contract is subject to and shall be constructed in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of English courts.

16. Brochure Description

16.1

All information supplied in brochure/website is correct to the best of our knowledge; the information supplied is for guidance purposes only and does not form any part of the contract.

17. Right of Entry

17.1

We and our agents reserve the right of entry at any time (including such workers as pool maintenance, gardeners, pest control etc)

18. Liability Disclaimer

18.1

The Villa is privately owned and neither ourselves nor our management company accept any liability whatsoever for any death, personal injury, accidents, loss or damage sustained during use of any facilities or equipment in the villa as part of the booking. In addition, no liability is accepted by us for loss of mains services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supplies of mains services. This extends to any other visitors to the villa or swimming pool, or for any loss or damage however caused to any property brought to the villa

18.2

It is guests’ responsibility to exercise a duty of care at all times and the principal/lead guest should ensure that their party follows all comprehensive operational and safety instructions relating to the use of facilities and equipment, familiarise themselves with the fire procedure displayed in the home and booklet and confirm all persons using the villa are adequately covered by appropriate personal accident/injury/public liability insurance

19. Credit Card/PayPal Payments

19.1

There is a 2.5% fee with all credit card and PayPal payments; This Charge is the fee to us for processing the payment through the Bank or PayPal. Debit Cards – No Charge

20. BBQ

20.1

There is a BBQ on the patio for your use, The neither the owner or the management co are responsible for cleaning the BBQ, It is up to the guests to clean after use and leave ready for the next guest, If you do not want to clean the BBQ please advise, there is a small charge for cleaning of £25.00 or $35.00. This will be deducted from your security deposit.
